1.3 "Organizer": the person or entity that licenses the Software, and its Host and Co-host appointees.
1.4 "Participant": any individual invited by or through an Organizer to take part in a game.
1.5 "Game": a single run of the Software arranged by an Organizer for its invitees.
1.6 "Participant Personal Data": a Participant's display name, mobile number, device identifier, game card/board or ticket, invitation record (clause 10), and any other personal data entered into the Software for the Game.
1.7 "Service": this website and Corporate Tambola, the Software offered through it.
1.8 References to an Act are to the Indian statute as amended from time to time.

2. Nature of the Service — software only

2.1 We are a software business. We license the Software to Organizers on a software-as-a-service basis. We do not organise, conduct, host, manage, operate or participate in any Game, and we are not a party to any arrangement between an Organizer and a Participant.
2.2 We do not offer, operate, facilitate or advertise any "online money game" or "online money gaming service" within the meaning of the Promotion and Regulation of Online Gaming Act, 2025. No Participant pays any fee, deposit or other stake to play, and no Game is played in expectation of monetary or other enrichment from a stake.
2.3 The Software is licensed, not sold. All software, source code, game engines, rules, designs, text, graphics, names and concepts of the Services are the exclusive property of Rajat Agarwal, trading as IT Services by Rajat Agarwal, and all intellectual property rights in them belong to Rajat Agarwal alone. The Organizer receives a non-exclusive, non-transferable, revocable right to use the Software for Games within the paid plan and period. No other right is granted. The Organizer shall not copy, modify, sub-license, reverse-engineer, resell or make available to any third party the Software or any part of it.

3. Closed-group Games; eligible Organizers

3.1 Every Game is a closed-group Game. It is accessible only by personal links issued through the Software on the Organizer's instruction. No Game is open to the public.
3.2 The Service is intended for companies, societies, associations and similar bodies ("corporate Organizers") for their employees, associates, vendors, customers, members, and the friends and families of any of them.
3.3 The Organizer alone decides whom to invite and whether family members may join.

4. Fees; no stake from Participants

4.1 The only charge is the Organizer's licence fee for the Software, shown before payment and payable through our payment service. The fee is for access to the Software and is not a stake, wager, entry fee or price of a chance in any Game.
4.2 Prices are the whole amount payable. GST is not charged, because the seller is not registered for GST. If the law later requires registration, GST will be added to Games created after we publish a notice. We issue an invoice for each payment. Where the law requires the Organizer to deduct tax at source, the Organizer shall deduct and deposit it and give us the certificate.
4.3 Cancellation, credit and rescheduling are governed by the refund policy displayed on the Service, which forms part of these Terms.

5. No collection and no payment by IT Services

5.1 We do not collect any money, deposit, contribution or other consideration from any Participant, in any form, for any Game.
5.2 We do not hold, pay, guarantee, transfer or deliver any prize, gift or money to any Participant.
5.3 Any prize, gift or recognition is provided, funded and handed over solely by the Organizer (or its Host) at its own cost and responsibility. The Software only records the result it computes.

6. No lottery; game cards

6.1 No Participant purchases any ticket, card or chance. A "ticket" in Corporate Tambola, and any game card, board, token or number, is issued free of charge, forms part of the Software's play interface and is not a lottery ticket within the meaning of the Lotteries (Regulation) Act, 1998.
6.2 The Software decides every win. The Organizer and IT Services have no means to add, remove or change a winner in the Software.

7. Prohibited uses by Organizers and Hosts

The Organizer shall not, and shall ensure that its Hosts, Co-hosts and Participants do not:
(a) charge or collect any fee, contribution, deposit, stake, entry money, subscription or "side bet" from any Participant in connection with a Game;
(b) link a Game to betting, wagering, pooling of money, or any scheme where money or money's worth is staked on the outcome;
(c) use the Software for any activity prohibited by the Promotion and Regulation of Online Gaming Act, 2025, the Public Gambling Act, 1867 or any State gaming law, the Lotteries (Regulation) Act, 1998, the Bharatiya Nyaya Sanhita, 2023, or any other law;
(d) use the Software for a game open to the public, or for a person under 18 except as clause 12 permits;
(e) share links outside the invited group;
(f) tamper with, reverse-engineer or interfere with the Software's fairness, randomness or sealed data.
We may suspend or end any Game or account, without refund of the licence fee for that Game, on reasonable suspicion of breach of this clause or if required by law, a court, or a competent authority. Participants may report suspected breaches to the Grievance Officer.

8. Prizes, taxes and compliance — Organizer's responsibility

8.1 The Organizer is solely responsible for any prize it offers, its funding, its delivery and any dispute about it.
8.2 The Organizer is the payer of any prize and shall comply with all tax laws, including deduction of tax at source on winnings from games of any sort under the Income-tax Act, 2025 (Section 393(3), Table Sl. No. 1, corresponding to former Section 194B of the Income-tax Act, 1961) where applicable (including the rule that tax on prizes in kind must be paid before release), and the tax and GST treatment of gifts to employees. We are not the payer, deductor or collector for any prize.
8.3 We recommend non-cash gifts. Cash prizes are at the Organizer's sole risk and responsibility.

9. Law of the place of play

9.1 Betting and gambling are State subjects under the Constitution of India, and the law differs from State to State. The Organizer is solely responsible for ensuring that a Game is lawful in every State in which it is played and for obtaining any permission required.
9.2 The Organizer warrants that, to the best of its knowledge, no Game it runs requires a licence or permission it does not hold.

10. Invitation record (chain)

10.1 Every personal link records who sent it and to whom, so that a chain of invitations can be shown. The record is used only to: (a) enforce the Organizer's guest limits; (b) detect and stop misuse of links; and (c) resolve a dispute between an Organizer and a Participant about participation.
10.2 The invitation record is Participant Personal Data and is erased with it under clause 11.
10.3 Business referral records between IT Services and its sales partners (not Participants) are separate and are kept as required by tax and accounting law.

11. Personal data, roles and 24-hour erasure

11.1 Roles. In respect of Participant Personal Data, the Organizer determines the purpose and means of processing and is the "Data Fiduciary"; IT Services is a "Data Processor" processing on the Organizer's behalf under these Terms as the contract required by the Digital Personal Data Protection Act, 2023 ("DPDP Act"), Section 8(2). In respect of the Organizer's own account, sign-in and billing data, IT Services is a Data Fiduciary.
11.2 24-hour erasure. We erase Participant Personal Data from our systems within twenty-four (24) hours after the Game ends, consistent with Section 8(7) of the DPDP Act. A Game that never starts is treated the same way, 23 hours after its scheduled end.
11.3 Limited exceptions. (a) Records IT Services must keep by law (tax and accounting law) concern the Organizer, not Participants. (b) Security and fair-play records, and diagnostic logs, are kept without Participant names or mobile numbers, for up to 365 days, as stated in our Privacy Policy. This includes visitor identifiers and shortened network addresses on public pages. (c) Encrypted backups are overwritten within 7 days. (d) Details of a winner (name and prize) are kept for 365 days so that the Organizer can confirm hand-over, and are then deleted automatically. (e) Anything a court or authority directs us to retain.
11.4 No verification of mobile numbers. We do not verify that a mobile number entered belongs to the person who entered it. The Organizer, as Data Fiduciary, is responsible for the accuracy and lawfulness of the invitee list and warrants that it has authority to invite each person.
11.5 Data minimisation. We ask a Participant only for what the Game needs. We do not sell data, run advertising trackers, or profile Participants.
11.6 Compliance posture. The Software is designed to comply with the DPDP Act and the Digital Personal Data Protection Rules, 2025, whose substantive duties commence in stages (principal provisions about eighteen months after 13 November 2025). Until then we apply the same standards voluntarily, together with the Information Technology Act, 2000 and rules made under it.
11.7 Rights. A Participant may, through the Organizer or directly to the Grievance Officer, ask what data is held, ask for correction or erasure, withdraw consent, or complain. We act within 30 days, and in any case within the period the law permits.
11.8 Breach. We will notify the Organizer without undue delay of any personal-data breach affecting Participant Personal Data, and cooperate with the Organizer's intimation to the Data Protection Board and affected persons as the DPDP Act requires.
11.9 Processors. We use infrastructure and service providers (hosting, database and e-mail delivery, and payment processing) on contracts that bind them to confidentiality and security. A current list is in our Privacy Policy.

12. Children

12.1 The Service is meant for adults. A person under 18 may take part only through a parent's or lawful guardian's device and with that parent's or guardian's permission given to the Organizer.
12.2 The Organizer, as Data Fiduciary, obtains the verifiable consent of the parent or guardian wherever the DPDP Act, Section 9, requires it. We collect nothing from a child beyond a display name, and we do not track, monitor the behaviour of, or direct advertising at children.

13. Software availability, fairness and results

13.1 The Software decides the result according to the published rules of the Game. The result is final, subject to correction of a demonstrable technical error by us.
13.2 Neither the Organizer nor IT Services can add, remove or change a winner in the Software.
13.3 Games run on Participants' own devices; interruptions of the internet or devices are not our responsibility.

14. Our limited role as intermediary; takedown

To the extent IT Services acts as an intermediary under the Information Technology Act, 2000, it will act on actual knowledge as required by Section 79(3)(b) as read by the Supreme Court in Shreya Singhal v. Union of India (2015) 5 SCC 1, and may disable a Game or link on a court order, government notification or credible notice of unlawful use.

15. Warranties and indemnity

15.1 The Organizer warrants that it has the right to invite those it invites, will use the Software lawfully, will not charge Participants, and will deliver any prize it promises.
15.2 The Organizer shall indemnify IT Services against loss, claim, penalty or cost arising from the Organizer's breach of clauses 7–9, 11.4 or 12, or from any prize, tax or dispute between it and a Participant, to the extent permitted by the Indian Contract Act, 1872.

16. Disclaimer and limitation of liability

16.1 The Software is provided "as is" for entertainment and engagement. We are not responsible for prize handover, tax on prizes, or disputes between an Organizer and a Participant.
16.2 To the extent permitted by law, IT Services' total liability to an Organizer for any claim in connection with a Game is limited to the licence fee paid for that Game. Nothing limits liability that cannot be limited by law.

17. Grievance Officer

Grievance Officer: Rajat Agarwal, IT Services by Rajat Agarwal, B-1105, Shipra Krishna Vista, Indirapuram, Ghaziabad, Uttar Pradesh, 201014, India. E-mail: rajatsiroffice@gmail.com (subject: Grievance). Phone: +91 96503 97480. We acknowledge a grievance within 48 hours and resolve it within 30 days (and in any event within the limit under the DPDP Rules). A person may also complain to the Data Protection Board of India once it is operational for the matter.

18. Electronic contract; how you accept

18.1 These Terms are an electronic contract. You accept them only by ticking the box shown on screen (publishing a Game, creating an account, paying, joining as a Participant, and similar). The boxes are never ticked in advance. Without the tick the action cannot proceed.
18.2 Each acceptance is recorded with the date, time, the version of these Terms and the wording of the box. Under Section 10A of the Information Technology Act, 2000 a contract is not unenforceable only because it is in electronic form.
18.3 If we publish a new version, an Organizer must tick again before publishing the next Game.

19. Changes; suspension

We may change these Terms for legal or technical reasons by publishing the new version; a change applies to Games created after publication. We may suspend a Service where required by law or an authority (including in light of any change in the law on online gaming).

20. Governing law, disputes and jurisdiction

20.1 These Terms are governed by the laws of India.
20.2 Disputes shall first be raised with the Grievance Officer. Failing resolution in 30 days, the dispute shall be referred to a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated at Ghaziabad, in English. Subject to this, the courts at Ghaziabad, Uttar Pradesh have exclusive jurisdiction.

21. General

Severability; no waiver; entire agreement together with the Privacy Policy, Refund Policy and the pricing page; no assignment by the Organizer without our consent; force majeure.

Consent boxes and records

  1. A box is never ticked in advance. The button that continues the action stays disabled until every box at that point is ticked.
  2. The server refuses the action unless the request carries the current version of these Terms and every required box. Ticking on screen alone is not enough.
  3. Each box carries a working label. The words Terms & Conditions, Privacy Policy and Refund Policy in it are links to the full text, which opens in a new tab.
  4. Each acceptance is recorded with the person or organisation, the game, the version of these Terms, the wording shown (by fingerprint) and the time. No IP address, device identifier or mobile number is stored in that record.
  5. A Participant's record is erased with the rest of Participant Personal Data within 24 hours after the game ends.
  6. When a new version of these Terms is published, every Organizer is asked to tick again before the next Game is published, paid for or joined.
  7. A person who does not tick cannot proceed.
